Scope and Contents
This case involves the dispute between the Jewell Ridge Coal Corporation and Local No. 6167, United Mine Workers of America, et al. The dispute involved underground travel time of bituminous coal miners from portal to portal. The UMW claimed that under the provisions of the Fair Labor Standards Act, portal to portal time must be included within their work week for purposes of Section 7 of the statute. The United States District Court, District of Virginia, ruled against the U.M.W. The United States Circuit Court, Fourth District, reversed the decision of the District Court. The case was then appealed to the Supreme Court of the United States. The Supreme Court upheld the decision of the Circuit court. The decisions in the case and in the previous case (Tennessee Coal) were overruled when Congress passed the Portal to Portal Act as an amendment to the Fair Labor Standard Act.
