Scope and Contents

This memorandum attempts to explore in as close chronological order as possible the appellate phase of the litigation in an effort to gather in one integrated document the language of the appellate courts. Mr Bergan's purpose was to dispel the charge of "litigous obstruction" which he believed was irresponsible.

Biographical / Historical

Thirteen rank and file teamster members from the New York City area brought suit in the Federal District Court to secure an injunction which would prevent the holding of an election for president of the international, charging that the election of delegates to the union's convention had been "rigged" to assure the election of James R. Hoffa. This was the beginning of the litigation which resulted in over 40 cases reaching the appellate courts. Hoffa was eventually elected, and a Board of Monitors appointed to supervise the actions of the executive board. This memorandum attempts to explore in as close chronological order as possible the appellate phase of the litigation in an effort to gather in one integrated document the language of the appellate courts.
